What is this settlement about?

The Plaintiffs claim that the Defendants conspired in restraint of trade, the purpose and effect of which was to suppress competition and to allow the Defendants and other Broiler chicken producers to overcharge for Broilers during the Class Period, in violation of federal antitrust law. Defendants deny all allegations of wrongdoing in this lawsuit. Some defendants have already settled this case, paying class members $170 million in the first round of payments. A second round of new payments totaling $115 million or more will be made to class members.

Who is qualified in the Settlement?

You are a member of the Direct Purchaser Settlement Class if you are a business that purchased raw Broilers directly from any of the Defendants listed below or their respective subsidiaries or affiliates either fresh or frozen, in the form of: whole birds (with or without giblets), whole cut-up birds, or parts (boneless or bone in) derived from the front half of the whole bird, for use or delivery in the United States from December 1, 2008 until July 31, 2019.

What is a qualified broiler?

A broiler is any chicken that is raised for meat consumption to be slaughtered before the age of 13 weeks, and which may be sold in a variety of forms, including fresh or frozen, raw or cooked, whole or in parts, or as a meat ingredient in a value-added product.
